Definitions

In these conditions the following terms shall have the following meaning “the company” means Car & Kitchen. “Customer” means the customer of the company. “Contract” means any contract for the sale of goods by the company to the customer.

 

Payment & Delivery

Payment is taken at the time of placing an order. No goods shall be supplied without payment.

Goods shall be delivered by a carrier of the company's choosing. Carriage will be at cost to the customer and forms part of the invoice.

Car & Kitchen aim to dispatch goods within 1 working day. Customers in the UK, please allow 3 working days to report to Car & Kitchen any outstanding orders, 7 working days for Europe, 10 working days for rest of the World.

The customer has to accept the goods when they are ready for delivery.

Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risk of loss, breakage and all damage and all other risks shall pass to the Customer.

 

Claims

Claims arising from damage delay or partial loss of the goods in transit must be made in writing to The company within seven working days of delivery.

The company shall be afforded reasonable opportunity to investigate any claim made hereunder, and the customer shall, if so requested in writing or verbally by the company promptly return any of the goods subject to any claim and any packing materials securely packaged and return them to the company for examination.

Car & Kitchen makes every effort to supply the goods as advertised but reserves the right to supply the goods subject to minor variations in actual dimensions, specifications and, in the case of bulk items, quantities without prior notice.

If Car & Kitchen cannot supply the goods ordered by the Customer, Car & Kitchen reserves the right to offer goods of equal or superior quality at no extra cost. In such a case, if the Customer does not wish to accept the alternative goods offered, he or she may cancel the order and require the refund of any money paid to Car & Kitchen in respect of that order. This shall be the sole remedy of the Customer in these circumstances.

Liability

If the customer establishes that any of the goods have not been delivered, or have been delivered damaged, or are not of the correct quantity, the company shall at its option, replace them with similar goods, or allow the customer credit for their invoice value.

If the customer establishes that any of the goods are defective the company shall, at its option replace them with similar goods or allow the customer credit for their invoice value.

In no circumstances shall the liability of the company to the customer under this condition exceed the invoice value of the goods.

 

Warranties & Returns

Car & Kitchen is committed to providing our customers with the highest quality products and service. However, on rare occasions, products may be found to be faulty or defective. In such cases, we offer the returns facilities described below.

All goods supplied by Car & Kitchen are warranted to be generally free from defects in workmanship and materials and fit for the purpose for which such goods would normally be used. If you purchase goods in the course of your business, all other express or implied terms or warranties relating to the goods are excluded to the fullest extent permitted by law. Subject to this, however, goods are not tested or sold as being fit for any particular or for use under specific conditions, unless expressly agreed in writing. All services provided by Car & Kitchen will be provided with reasonable skill and care and within a reasonable period. If you purchase services in the course of your business, all other express or implied terms or warranties relating to the services are excluded to the fullest extent permitted by law.

Subject to the right of consumers to return goods for refund under The Consumer Protection (Distance Selling) Regulations 2000 Car & Kitchen does not sell products on a trial basis. Customers are strongly advised to check suitability and specifications of products before ordering.

Under the United Kingdom’s Consumer Contracts Regulations, you have the right to cancel your order up to 14 days after order receipt date, Car & Kitchen at its discretion (unless the Consumer Protection (Distance Selling) Regulations apply) agrees to accept the return for credit of unwanted products as long as the items are in their original condition, with all tickets and tags attached. Failure to keep the items in an unused, resalable condition may result in a reduced refund.

The Customer will be responsible for the cost of returning the goods if he or she exercises this right of cancellation under the Regulations. If the Customer does not actually return the goods to Car & Kitchen, the Customer is under a duty to make the goods available for collection at the Customer’s expense from the address to which they were delivered.

The Customer is under a duty to retain possession of the goods whilst awaiting return to Car & Kitchen and to take reasonable care of them during this period. The Customer will be liable for any loss of or damage to the goods if he or she fails to comply with this obligation.

Car & Kitchen offers a 28 returns policy from the date of receiving the goods. In this instance all refunds exclude postage costs, unless a mistake has been made by us.

We regret that we are unable to offer this policy on any sale or clearance items unless proven faulty. Sale items may be returned within 14 days.

Specifications

The Company reserve the right to alter specifications to those stated on the website, including slight differences in colour, shade materials and size. The customer’s statutory rights will not be affected.

 

Errors and Omissions

Car & Kitchen makes every effort to ensure that all prices and descriptions quoted on its website are correct and accurate. However, the frenetic tempo of e-commerce makes it inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, Car & Kitchen will be entitled to rescind the contract, notwithstanding that it has already accepted the Customer’s order and/or received payment from the Customer. Car & Kitchen’s liability in that event will be limited to the return of any money the Customer has paid in respect of the order. In the case of a manifest error in relation to price, the Customer will be entitled to purchase the goods by paying the difference between the quoted price and the correct price, as confirmed in writing by Car & Kitchen after the manifest error has been discovered.

A 'manifest error', as the term is used in these terms & conditions, means, in relation to an incorrect price, a price quoted in error by Car & Kitchen which is more than 10% less than the price that would have been quoted had the mistake not been made.

C&K - An Independent Department Store

We are a family-run independent department store based in Settle, North Yorkshire, at the gateway to the stunning Yorkshire Dales. Spread over two floors, C&K offers a thoughtfully curated range of homeware, gifts, kitchenware, children’s toys and games, cards and stationery, women’s fashion and accessories — plus a welcoming in-house café on the first floor.

Our aim is to be more than just a shop; we want C&K to be somewhere you look forward to visiting — a welcoming place full of inspiration, interesting finds, and good food & great coffee.

C&K first opened its doors in 1976, founded by Henry’s grandparents. Known locally as Car and Kitchen, the business quickly earned its place as a Settle institution. Originally converted from a garage, the shop blended an unusual mix of car parts and kitchenware — a true reflection of Henry’s grandparents’ innovation and entrepreneurship at the time.

A few years later, the business evolved again when Henry’s parents, Ken and Liz, joined the team. Liz had a natural flair for buying gifts, homeware, and fashion, while Ken — an intrepid foodie — opened a café upstairs, adding another layer to the store.

In 2014, Henry and Tash became part of the business. They have worked to reimagine the space thoughtfully — building on the foundations laid by previous generations, while gently evolving C&K into what it is today. Their aim has always been to carry forward the original spirit of Car and Kitchen: a welcoming place filled with interesting finds, good food, and a strong sense of community.

Over time, C&K has built a reputation for its eclectic mix of gifts, homeware, kitchenware, and women’s fashion — a reputation that continues to grow today.
